By accessing or using the Ilk application and website ("Service"), provided by Kovio GmbH ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
You must be at least 18 years old to use Ilk. When you create an account, you confirm that you are 18 or older and that you accept these Terms and the Privacy Policy. We delete accounts of people under 18 when we learn about them.
Ilk is a social discovery application that connects like-minded people nearby through shared interests. Users are matched by weighted interest trees and shared passions — not by photos or profile swiping. The app features anonymous-by-default identity, avatar-based profiles, interest-first matching, and proximity-based map discovery.
We provide the Service "as is". We work to keep it available and free of errors, but we do not guarantee that it is always available or free of errors. We can change, add or remove features.
To use the app, you must register for an account. You agree to provide accurate, current, and complete information and maintain the security of your password. You are responsible for all activities that occur under your account.
Ilk is designed to be private by default. Your profile does not require a photo, and your exact location is never exposed to other users. How we collect, use, and protect your data is detailed in our Privacy Policy. By using the Service, you consent to our data practices as described therein.
You agree not to use the Service to:
Reports. You can report a person or a message and block a person in the app. A report also blocks the person. You can add an explanation to a report. If you do not have an Ilk account, report content to support@ilkapp.com.
Review. A person at Ilk reviews every report and decides. No algorithm decides. We review a report within 24 hours on work days (Monday to Friday). We review a report of a threat of violence or self-harm on the same day, also on weekends. To decide, we read the messages between the two people, their profiles and the explanation of the report.
Actions. If content or an account violates these standards, we can:
We take these actions without prior notice. If we remove content, or suspend or delete an account, we send the affected person an email with a statement of reasons on the day of the action. It names the action, the content concerned, the term in this section that the content or the account violated, and that a person decided. It never names the person who reported. The person who reported receives an email with the result: we took action, or we found no breach of our terms.
Contest a decision. If you do not agree with a decision, reply to the email with the statement of reasons. A person at Ilk reviews the decision again. You can also take the matter to a court.
Ilk includes AI companions. They are always marked with an "AI" badge. They are not real people. Before your first conversation with an AI companion, the app asks for your consent: the messages that you send to AI companions go to third-party AI providers so that the companion can reply. The Privacy Policy names the providers. You can withdraw this consent in the app settings. AI companions can make mistakes, and they do not give professional advice of any kind (for example medical, legal or financial advice).
Ilk is free to use. The app has no in-app purchases. If we add purchases later, we will update these Terms before they become available.
While you own the content you create (messages, profile data, interests), Kovio GmbH retains all rights, title, and interest in the Ilk app, website, original content, features, design, avatar system, and functionality. You may not reproduce, distribute, or create derivative works without our express written permission.
To the maximum extent permitted by applicable Swiss law, Kovio GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use the Service.
You can delete your account at any time in the app (Profile → Settings & Privacy → Legal → Delete account) or as described on Delete your account. Deletion removes your profile and personal data. Messages that you sent stay visible to the people you chatted with, as the Privacy Policy describes. We reserve the right to suspend or terminate your account if you violate these Terms of Service, as section 6 describes.
We reserve the right to modify these Terms at any time. We will notify you of any material changes via the app or email. Continued use of the Service after changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Canton of Schwyz, Switzerland.
